(facsímil BOP). 1836 Lg 1590-1The 1978 Constitution entrusted The Provincial Council with the responsibility of governing and taking charge of the administration of the municipalities of the province of Málaga. As a local and administrative entity, the Council has played an important role (alongside other public institutions) in shaping the liberal state since its origins in the 19th century. It also represents an important step in the journey towards the establishment of the democratic state and the civil service, as well as the process of territorial distribution.

The Council acquired importance as an intermediate local institution through the 1978 Constitution, which deemed provincial councils responsible for governing their respective provinces. Many different statutes regulate the institutional relationships between the Provincial Councils and the Autonomous Community of Andalucía, specifying the relevant jurisdiction and legal competence of each, so that these institutions can provide the advice and cooperation required by the people, and promote the general interests of the province.
